Workshop Terms of Service

Use

The following terms and conditions regulate the collaboration between Milan Art Institute and the instructors in connection with all the services which are provided within the scope of Workshops operated by Milan Art Institute.

Workshop cancellations

If, for any reason, you need to cancel your attendance to the workshop after you’ve registered, you can get a full refund within 24 hours of your purchase. After this time period is over, you can apply the workshop fee to any other workshop or product (including the Mastery Program) Milan Art Institute offers. However, you must inform us at least 72 hours before the workshop to be able to transfer the credit to another workshop or product.

Exclusions

Milan Art Institute is not liable for airfare, housing, boarding, transportation or any other costs that might incur due to special circumstances. 

Changes and rights to changes

Milan Art Institute reserves the right to make changes to the Workshop at any time. If for any reason beyond Milan Art Institute’s control, a venue or service issue prevents the Workshop from taking place, Milan Art Institute will try to make alternative arrangements. If the alternative options are not viable, Milan Art Institute will issue a refund to the customer.

In case of force majeure, Milan Art Institute reserves the right to change dates or venues and will inform the participants in a timely manner. If the alternative arrangements are not accepted by a certain number of workshop participants, determined by Milan Art Institute, Milan Art Institute will refund any money paid to Milan Art Institute by guests.

If services or inclusions changes result in price changes, Milan Art Institute will refund the difference to participants or will cover the expenses to replace the service.

Exclusivity and copyright

All information displayed on the website is owned by Milan Art Institute and will not be passed to third parties without given consent from those directly involved and special permission granted by Milan Art Institute.

Instructors and guests acknowledge that while participating in the Workshop, photos and videos might be taken by guests, instructors, Milan Art Institute or its representatives. Instructors and guests consent to any such materials being taken and grant a perpetual, royalty-free, worldwide, irrevocable license to Milan Art Institute to reproduce for any purpose whatsoever (including marketing, promotions, promotional materials) without any further obligation or compensation payable to them. Both Milan Art Institute and the instructor will hold the right to use the materials. The use by any other parties without a special permission from Milan Art Institute is strictly prohibited.

All image rights belong to Milan Art Institute or its partners.

Participation policy

There will be no reimbursement for any classes missed or services not used. Furthermore, all guests participate in the classes at their own risk and must employ their own judgment as to which activities are appropriate for their level of training and experience, as well as mental stability.

Participants are required to purchase travel, medical, and cancellation insurance for protection against any circumstances that might require cancellation or change of travel arrangements.

Limitation on Liability

IN NO EVENT WILL MILAN ART INSTITUTE, ITS AFFILIATES OR THEIR LICENSORS, SERVICE PROVIDERS, EMPLOYEES, AGENTS, OFFICERS OR DIRECTORS BE LIABLE FOR DAMAGES OF ANY KIND, UNDER ANY LEGAL THEORY, ARISING OUT OF OR IN CONNECTION WITH YOUR USE, OR INABILITY TO USE, THE WEBSITE, ANY WEBSITES LINKED TO IT, ANY KIND OF INJURY THAT MAY OCCUR DURING A WORKSHOP, INCLUDING ANY DIRECT, INDIRECT, SPECIAL, INCIDENTAL, CONSEQUENTIAL OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO, PERSONAL INJURY, PAIN AND SUFFERING, EMOTIONAL DISTRESS, LOSS OF REVENUE, LOSS OF PROFITS, LOSS OF BUSINESS OR ANTICIPATED SAVINGS, LOSS OF USE, LOSS OF GOODWILL, LOSS OF DATA, AND WHETHER CAUSED BY TORT (INCLUDING NEGLIGENCE), BREACH OF CONTRACT OR OTHERWISE, EVEN IF FORESEEABLE.

THE FOREGOING DOES NOT AFFECT ANY LIABILITY WHICH CANNOT BE EXCLUDED OR LIMITED UNDER APPLICABLE LAW.

Indemnification

You agree to defend, indemnify and hold harmless Milan Art Institute, its affiliates, licensors and service providers, and its and their respective officers, directors, employees, contractors, agents, licensors, suppliers, successors and assigns from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses or fees (including reasonable attorneys’ fees) arising out of or relating to your violation of these Terms of Use or your use of the Website, including, but not limited to, your User Contributions, any use of the Website’s content, services and products other than as expressly authorized in these Terms of Use or your use of any information obtained from the Website.

Waiver and Severability

No waiver by Milan Art Institute of any term or condition set forth in these Terms of Use shall be deemed a further or continuing waiver of such term or condition or a waiver of any other term or condition, and any failure of the Company to assert a right or provision under these Terms of Use shall not constitute a waiver of such right or provision.

If any provision of these Terms of Use is held by a court or other tribunal of competent jurisdiction to be invalid, illegal or unenforceable for any reason, such provision shall be eliminated or limited to the minimum extent such that the remaining provisions of the Terms of Use will continue in full force and effect.

Educational Courses and Workshop Recordings:

Due to the nature of digital products, refunds for one time payments of our educational courses and workshops must be requested within the first 24 hours and can only be issued if there is zero amount of watch time on the videos. Once you have begun watching the videos, we cannot issue a refund. 

Refunds are not available for accounts which have violated the terms of service; violations are determined at Milan Art Institute's sole discretion. If Milan Art Institute determines that you are abusing our refund policy, we reserve the right to suspend or terminate your account and refuse or restrict any and all current or future use of the Service without delivering a refund.
